Welcome to ClikSo! These Terms of Service ("Terms") govern your access to and use of the ClikSo website (https://clik.so) and services (collectively, the "Service"), operated by Playxoft Studios Private Limited, a company registered in India ("Company," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Eligibility

You must be at least 18 years of age to use this Service. By creating an account or using ClikSo, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Acceptable Use Policy

We maintain a zero-tolerance policy towards abuse. You agree NOT to use ClikSo to shorten, share, or promote links that direct to:

  • Phishing or Malware: Sites that attempt to steal user data or install malicious software.

  • Spam: Unsolicited bulk messaging, SMS spam, or email spam.

  • Illegal Content: Content that is criminal in nature, including but not limited to child sexual abuse material (CSAM), non-consensual sexual imagery, or illegal goods/services (e.g., weapons, drugs, black market items).

  • Hate Speech & Harassment: Content that promotes violence, discrimination, or harassment based on race, ethnicity, religion, gender, or sexual orientation.

  • Pornography: Explicit adult content.

Violation of this policy will result in the immediate permanent suspension of your account and banning of your IP address.

3. Abuse Prevention & Monitoring

To ensure the safety and integrity of our Service, we reserve the right to:

  • Monitor Links: We employ automated systems and manual reviews to scan shortened URLs for malicious content.

  • Track Usage: We log IP addresses and analyze usage patterns to identify potential abuse.

  • Prevent Exploitation: Creating multiple free accounts to bypass usage limits is strictly prohibited. If detected, all associated accounts will be banned.

4. Account Termination

We reserve the right to suspend, disable, or terminate your account or disable specific links immediately and without prior notice if:

  • We verify or suspect a violation of these Terms.

  • We receive a valid abuse report from a third party or law enforcement agency.

  • You engage in activity that disrupts or harms our Service or infrastructure.

5. Payments & Subscriptions

We use third-party payment processors to handle transactions. By making a purchase, you also agree to their respective terms.

  • India: Payments are processed by Razorpay.

  • Global: Payments are processed by Lemon Squeezy (acting as the Merchant of Record).

Refunds & Liability

  • Free Plan: The Free Plan is provided "AS IS" without any warranty or liability. You use it entirely at your own risk.

  • Paid Plans: Our liability for any claim related to a paid subscription is strictly limited to the amount you paid to us in the 6 months preceding the claim.

  • Compensation: Compensation for service downtime or errors is not guaranteed and may be provided as service credits or discounts at our sole discretion.

6. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PLAYXOFT STUDIOS PRIVATE LIMITED EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PLAYXOFT STUDIOS PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;

  2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;

  3. ANY CONTENT OBTAINED FROM THE SERVICE; AND

  4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Kanchipuram or Chennai, Tamil Nadu, India.
